The pharmaceutical industry wouldn’t be alone in opposing a requirement to include a list price in advertisements. The business community in general is wary about any plans to compel speech in advertisements. Dan Jaffe, who leads government relations for the Association of National Advertisers, told CQ before the rule was released that requiring list prices in ads likely wouldn’t meet First Amendment requirements that the courts have laid out. “Advertising needs to be truthful and non-deceptive,” he said. But given the complexities of how a drug’s list price relates to what a patient actually pays, he didn’t think the government could find a way to ensure it was not deceptive or misleading.
